Audio Use License

1. Overview

• This Audio Use License (“License”) is a legal agreement between Rare Finds Sound Design (“RFSD”) and the person or organisation accessing or using any of RFSD’s audio recordings (“Licensee”).

• By downloading, purchasing, or otherwise obtaining any RFSD audio files (the “Materials”), you accept these terms in full.

2. Authorised Use

• Subject to full compliance with this License, RFSD grants the Licensee a non-exclusive right, lasting for the life of the Materials, to integrate the Materials into new, original projects.

• All RFSD Materials come with a commercial license. Meaning you can use the Materials for commercial and non commercial projects.

• No ongoing royalty payments are required once the Materials have been lawfully obtained. We do not run a subscription based service.

Examples of acceptable use include:

• Incorporation of Materials into video, film, streaming content, animation, games, apps, theatrical works, podcasts, installations, and other creative media.

• Creative modification of the Materials, including editing, processing, combining with other sounds, or adapting them for artistic purposes.

• Sharing or distributing completed works containing the Materials, provided the Materials cannot be isolated or reused by others.

• Attribution is optional but appreciated and can be done so by referencing the RFSD website or social media channels.

3. Limitations

The following actions are not permitted under this License:

• Using the Materials, in whole or in part, to create, distribute, or sell new sound-effect libraries, sample libraries, or other collections, whether the Materials are unmodified, edited, layered, processed, or otherwise altered.

• Hosting, uploading, reselling, leasing, sharing, sublicensing, or making the Materials (or any substantially unmodified portion thereof) available to others in a manner that allows them to download, extract, or reuse the Materials separately from your finished audiovisual or interactive project.

• Using the Materials to build or train artificial intelligence systems, machine-learning models, or datasets.

• Using the Materials as content or source material for commercial sound libraries, sample packs, archives, virtual instruments, plugins, or other products designed or intended to provide reusable audio assets without a separate written agreement.

• Including the Materials in templates, generator tools, or other products where end users are expected to reuse, extract, or repurpose the Materials.

• Using the Materials as playable individual notes or as source content for sample instruments unless sufficiently transformed so they cannot function as standalone reusable assets.

• Using the Materials, in whole or in part, to create or upload ASMR, or similar content to video or audio platforms (including, but not limited to, YouTube, TikTok, Instagram, or other audio streaming services) for the purpose of monetisation, advertising revenue, or other commercial gain, without prior written permission from RFSD.

4. Definition of a Finished Project

• A “finished project” means a work in which the Materials are integrated into a larger audiovisual, interactive, or multimedia product such that the Materials cannot be accessed, isolated, or reused as standalone audio files.

5. Intellectual Property

• All copyrights, neighbouring rights, and other proprietary rights in the Materials remain the sole property of RFSD (or its licensors).

• This License gives you permission to use the Materials in your work and projects; it does not transfer ownership.

6. Quality & Risk

• The Materials are supplied without warranty of any kind. RFSD does not guarantee that the Materials will meet the Licensee’s technical or creative requirements or that they are compatible with specific software or hardware.

• To the extent permitted by law, RFSD is not responsible for any loss, damage, or interruption arising from your use of the Materials.

7. External Sites & Services

• The RFSD website may include references or links to other services or resources. RFSD does not control or endorse any third-party content and is not responsible for any loss or issues arising from use of such services.

8. Multi-User & Organisation Use

• If the Materials will be accessed by multiple individuals within a company, studio, production team, education or similar organisation. Or if you require expanded rights beyond those in this License. You must obtain written permission from RFSD. Each individual user requires their own license unless otherwise agreed in writing.

9. Modifications

• RFSD reserves the right to amend, modify, or update this License at any time, in its sole discretion. When we make changes, we will post the revised version on our website at https://rarefindssounddesign.com/pages/license-agreement and will update the “Last Updated” date at the top of this Agreement.

• By continuing to use, download, purchase or otherwise obtain any of the Materials after such modifications become effective, you agree to be bound by the updated terms. If any changes are unacceptable to you, your sole remedy is to discontinue use of the Materials.
